COUNCIL PROCEEDINGS

CITY OF ATTICA

June 12, 2006

 

The Common Council for the City of Attica met on the 12th day of June at the hour of 7:00 p.m. at City Hall.  Those present: Mr. Larry Grant, Mr. Harold Burris, Mr. Bill Craft, Mr. Larry Askren, Mrs. Valarie Maus, Mr. Tom O’Connor, Mr. Deon Swift, and Ms. Sharon Negele. 

 

APPROVAL OF MINUTES FROM PREVIOUS MEETING

Mr. Askren made a motion to approve the minutes of the May 8th council meeting, seconded by Mr. Burris.

 

COMMITTEE REPORTS

Mr. Grant presented the Attica Area Planning and Zoning report for the Alton property on Ruppert Rd.  The committee felt that there should be further research to determine if the property is zoned Agricultural or Suburban.  Ms. Jordan presented new information that the property is indeed zoned Suburban and that she would be able to issue the building permit.

 

DEPARTMENT HEADS

Mr. Jean reported that the residents of Golfridge subdivision have made a request for streetlights.  Duke energy has quoted 2 lights at $2,700 per light and $10 per month.  Mr. O’Connor said he would like to check on the state statute to determine the city’s obligation.  Chief Snoeberger presented a Merit award to Officer Galloway and Officer Heeter for their heroic efforts in saving Don Butler from his burning house.  Officer Galloway was present to receive his award. 

Mr. Swift announced that the Park program is experiencing great attendance (60-90 attendees per day) and he wanted to extend his gratitude to the department of Child Services for their continued support.  He also wanted to thank Melinda and Bob Shepherd for their hard work in beautifying the parks

 

UNFINISHED BUSINESS

Mr. O’Connor presented the proposed Swimming pool Ordinance #5.  Mr. Askren made a motion to read the ordinance. It was not seconded.  Mr. Grant made a motion to table the ordinance to allow time to read the state statute that the proposed ordinance refers to and Mr. Burris seconded, majority ayes.   Mr. O’Connor presented Ordinance #6 which contains the required verbiage addressing the flood plain zones from the DNR.  This is a requirement if the citizens residing in the floodplain would like to be eligible for National Flood Insurance.  Mr. Craft made a motion to read the Ordinance for the 1st time and 2nd time by title only.  Mrs. Maus seconded the motion, all ayes.  Mr. Burris made a motion to suspend the rules for the 3rd reading and vote.  Mr. Craft seconded the motion.  Roll call was taken, 5 ayes, 0 nays. 

 

NEW BUSINESS

Mr. O’Connor presented the tax abatement compliance report from C&D Battery.  Mr. Craft made a motion to accept the report and Mr. Burris seconded the motion, all ayes. 

Ms. Negele presented information received during a Clerk/Treasurer State Board of Accounts.  She is currently analyzing court software and is still waiting to receive a reasonable time frame on what the state plans to offer in conjunction with its online system.  New cemetery software was purchased to replace the old DOS based program.  Data conversion was quite expensive so the solution will be to input history over time with existing staff and part time help.  The SBOA meeting revealed that the Major Moves distribution to our city would be approximately $48,000 to be distributed over two years in two lump sums around October.  This money will be deposited in the MVH fund and will be treated as a windfall.  The riverboat gambling distribution is expected to be approximately $22,000.  Additional public laws passed that are of interest are as follows:

  • P.L. 82 – Child curfew – A minor can have a note from a parent after 11:00PM to avoid violation.
  • P.L. 162 – Circuit Breaker – There will be a 2% property tax cap.
  • P.L. 165 – City owned golf courses can now legally sell alcohol.
  • P.L. 169 – Rainy day transfers can happen anytime of the year.  Bid threshold for third class cities has been raised to $50,000 for public works projects.  Salary Ordinance must be passed by 10/1 and raises can be given anytime of the year by ordinance except for politicians.
  • P.L. 187 – Fireworks in backyards are legal.  Transfers between departments will not require DLGF approval only by resolution.

 

MISCELLANEOUS BUSINESS

Mr. Swift reported that the siren at the High School has been repaired and tested.  The City Building generator has been ordered and should be installed by early July.  Emergency Management has pledged money toward the purchase of the new generator.  Also the director of Emergency Management was pleased to find out that both Chiefs of our Fire & Police Department have completed the NIMS certification. There is a garden tour on June 17th and a Mayor’s dinner for Joe Harrison on June 24th and a presentation at the library on the 25th from (2-4pm).

There being no further business to come before the council, Mr. Craft made a motion to adjourn, seconded by Mrs. Maus, all ayes.
