COUNCIL PROCEEDINGS
CITY OF ATTICA
September 13, 2004
The Common Council for the City of Attica met on the 13th day of September 2004 at the hour of 7:00 p.m. at city hall. Those present: Mr. Bill Craft, Mr. Larry Grant, Mrs. Valarie Maus, Mr. Harold Burris, Mr. Larry Askren, Mr. Deon Swift, and Ms. Sharon Negele.
APPROVAL OF MINUTES FROM PREVIOUS MEETING
Mrs. Maus made a motion to approve the minutes of the August 9th and August 30th, 2004 meetings, seconded by Mr. Craft.
CITIZENS PETITIONS
Greta Brown and Yvonne Long asked the council for consideration of an amendment to either zoning or a noise ordinance regarding off road vehicles operating on private property within the city limits. Mr. Burris made a motion to refer this request to the zoning committee and Mr. Craft seconded the motion. All ayes. The mayor appointed Zoning Committee will be meet on Tuesday, September 21, 2004 at 6 p.m.
DEPARTMENT HEADS
Mr. Jean reported that the lights were installed by PSI down by the river but are directed toward the wrong direction. He has contacted PSI to correct this issue. In addition we received another FEMA check for the damage incurred in 2003. Mr. Snoeberger reported the APD are preparing for Potawatomi weekend. Mr. Turpin presented a statistical report regarding the 2004 park department. The overall improvement as a result of the new pool liner created a significant savings from safety /prevention, chemicals and water usage. The concession stand reported a net profit of $1,400 without reflecting some remaining credits. The Park Program was a success with great attendance contributing to a 13-year history in the making. Next year goals will include 5 new steel doors, baby pool liners and a general overall cleanup/painting in the concession area.
UNFINISHED BUSINESS
Mr. Grant made a motion to accept the proposed 2005 Budget and Mr. Burris seconded the motion. A roll call was taken and all ayes were given. Mrs. Maus made a motion to read Ordinance #4 for the third time and Mr. Craft seconded. Mrs. Maus made a motion to adopt the ordinance #4 and Mr. Grant seconded. A roll call was taken and all ayes. Mr. Craft made a motion to read Ordinance #5 for the third time and Mr. Burris seconded. Mr. Burris made a motion to adopt the ordinance #5 and Mr. Craft seconded. A roll call was taken and all ayes. Mrs. Maus made a motion to read Ordinance #6 for the first time, by title only the second time, all ayes. Mr. Grant made a motion to read Ordinance #7 for the first time and by title only the second time, all ayes. Mr. Grant then asked for the Ordinance #7 to be tables and Mrs. Maus seconded, all ayes.
NEW BUSINESS
Mr. Swift announced the Board of Works has opened the trash contract to bidding. The council will be informed on the progress. Ms. Negele announced that in the near future we would be offering automatic bank drafts for utility bill payment upon completion of software updates.
MISCELLANEOUS BUSINESS
Mr. Swift informed the Council that the Norfolk & Southern railroad would be doing some tie replacement soon. He was informed that the North Perry street crossing would be shut down for 2-3 days. Mr. Grant offered to make a call to his contact at the railroad to discuss a possible traffic redirection instead of closing the crossing. Mr. O’Conner commented that the railroad works under Federal Law and we can only ask them to consider our suggestion. Mrs. Maus inquired if there was a definition on how many family members can live a residence zoned as a single-family dwelling. Mr. O’Conner stated that our Ordinance does not define a number. Mrs. Maus also inquired about bathroom facilities for out of town visitors and the cemetery. Mr. Swift explained that during business hours that the working shed offers a bathroom if necessary. Mr. Burris raised the concern of parked cars at the intersection of Cedar St. and Maple. Mr. Snoeberger will investigate the issue.

There being no further business to come before the council, Mrs. Maus made a motion to adjourn, seconded by Mr. Craft.
