The
Common Council for the City of Attica met in special session on the 10th
day of September 2001 at the hour of 7
p.m. at city hall. Those present: Mr. Larry Grant, Mr. Curt Phelps, Mrs. Valarie
Maus, Mrs. Kay Gustus, Mr. Bill Craft, Mr. Tom O'Connor, and Mr. Deon
Swift. Absent: Mrs. Nancy Mitchell.
APPROVAL
OF THE MINUTES
Mr.
Phelps made a motion to approve minutes of the previous meeting, seconded by
Mrs. Gustus. All ayes.
COMMITTEE
REPORTS
Mr.
Grant reported the Zoning and Planning Commission met on August 21 regarding
property at 503 East Washington Street.
A request for rezoning has been made from R-1 (Single Family
Residential) to R-2 (Two Family and Group House Residential). The committee recommended the council approve
the rezoning. Mrs. Gustus made a motion
to approve the recommendation, seconded by Mrs. Maus. All ayes. Mrs. Gustus
then made a motion to read Ordinance #13 in full, seconded by Mrs. Maus. All ayes.
Mr. O'Connor read: ORDINANCE
#13, 2001, AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ZONING MAP FOR THE

made a motion to suspend the rules and read for the third time, seconded by

SECTION
4. In addition to the established
maximum rates for hourly employees for the calendar year 2002 as established in
Section 3, it is hereby ordained that the Mayor of the City of Attica, upon
approval by the Common Council, shall be authorized to allow additional pay of
a maximum of 25 cents per hour to that above established hourly employees rate.
SECTION
5. In addition to the established
maximum rates for full time and salaried employees for the calendar year 2002
as established in Section 1,2, and 3, it is hereby ordained that the City of
Attica will pay mandatory contributions for all full time elected officials,
appointed officials, and employees as required by the Public Employees
Retirement Fund.
SECTION
6. This Ordinance shall be in full
force and effect from and after its publication as required by law and its
adoption by the Common Council of the City of Attica, Fountain County, Indiana.

Swift reported the Phoenix Tank Service Contract is $8,700 per year for the
maintenance on our water tower. Mr.
Phelps made a motion to allow the Board of Works to be authorized to enter into
a contract with Phoenix Tank Service and that proper funds from the Water
Department be appropriated to meet that annual expense, seconded by Mrs.
Gustus. All ayes.
Mr.
Phelps made a motion to table the roofing project with Sentry Roofing until the
October meeting, seconded by Mr. Grant.
All ayes. Mayor Swift requested
Mr. John Tingley, representative of the company, to be present at that time.
MISCELLANEOUS
BUSINESS
Mr.
O'Connor informed the council that there is a specific Indiana State Statute
that deals with overdue sewer bills.
Once a sewer bill becomes sixty days delinquent, the Clerk's office can,
within twenty days of the delinquency, send a notice to the property owner, not
the occupant, informing him of his responsibility in paying the delinquent
bill. Quarterly, the Clerk's office is
to prepare a list, which consists of the names, addresses and legal description
of the property and the amount of delinquency.
That list is given to the county auditor. The Clerk notifies the property owner that a tax lien is going to
be placed on the property. Once a year,
prior to December 15, the Clerk's office certifies the county auditor those
people on the list who have not paid.
That information is put on the tax rolls in May of the following year.
Mayor
Swift and the council held a discussion concerning a Rainy Day Fund which he
said gives the city the same prerogative as it does the county and the
state. The city can take ten per cent
of what is left of the line items and save it in a Rainy Day Fund for the next
year. Mr. O'Connor explained that the
amount that goes into the fund at the end of the year would be by council
action and when the money is appropriated out of that fund, it's done by
council action. The proposed use of the
Rainy Day Fund should be consistent with the intent of the fund. The Council appropriates the money and the
Board of Works monitors it. Further
discussion was tabled to a later date.
Mayor
Swift said a budget line item had been changed on the Police Department. That change was back to $9,000 on Police Car
Operation and $1,000 for an interpreter.
Mrs. Gustus made a motion to adopt Budget 2002, seconded by Mr.
Grant. Roll was called: ayes 5, nays 0. Mrs. Gustus made a motion to adopt the 2002 Budget, seconded by

There
being no further business to be brought before the council Mr. Phelps made a
motion to adjourn, seconded by Mrs. Gustus.
