OCTOBER 8, 2001

CITY OF ATTICA

 

 

The Common Council for the City of Attica met on the 8th day of October 2001 at the hour of 7 p.m. at city hall.  Those present:  Mrs. Kay Gustus, Mrs. Valarie Maus, Mr. Curt Phelps, Mr. Larry Grant, Mr. Deon Swift, and Mr. Tom O’Connor.  Absent:  Mr. Bill Craft.

 

APPROVAL OF THE MINUTES

Mr. Phelps made a motion to approve minutes of the previous meeting, seconded by Mrs. Gustus.  All ayes.

 

CITIZENS PETITIONS

Mr. O’Connor, City Attorney, announced that a request had been made by Covington Foods Incorporated to close a portion of the alley that is just east of the IGA store in Attica that runs north and south.  He explained to those representatives that a petition to vacate that alley would be filed with the council.  The council would then set a public hearing on that petition.

Mr. O’Connor said a public notice of the hearing was published and notice sent to utility companies.  Mayor Swift opened the public hearing on the petition to close the alley.  Mr. Duane Roderick, representing Attica IGA, was present.  He said IGA is looking to expand and thought it best to build to the east.  He has checked with utility companies involved and said all

utilities located at the alley are moveable.  Mr. Roderick had check with Mr. Ron Swadley, of Swadley Drugstore, who said he had no problem with the expansion.  IGA posted in their store information regarding their expansion and welcomed any questions citizens might have.  Mr. Roderick said IGA would like to break ground by the end of March or the first of April 2002.  Mrs. Gustus made a motion to close the public hearing, seconded by Mrs. Maus.  All ayes.  Mrs. Gustus made a motion to read Ordinance #14 for the first time in full, second time by title only, seconded by Mrs. Maus.  All ayes.  Mr. O’Connor read in full:  ORDINANCE #14, 2001 AN ORDINANCE VACATING ALLEY IN THE CITY OF ATTICA INDIANA.  Mr. O’Connor then read by title only:  ORDINANCE #14, 2001 AN ORDINANCE VACATING ALLEY IN THE CITY OF ATTICA, INDIANA.  Mrs. Gustus made a motion to read for the third time in full, suspend the rules and adopt, seconded by Mr. Phelps.  All ayes.  Mr. O’Connor read in full:  ORDINANCE #14, 2001 AN ORDINANCE VACATING ALLEY IN THE CITY OF ATTICA, INDIANA.  The roll was called.  Four (4) ayes, 0 nays.

 

DEPARTMENT HEADS

Police Chief Gene Snoeberger reported that it was necessary to purchase a new copier for the police station.  Judge Mark Mason agreed to share half the purchase price of $2,800 from probation fees.  Chief Snoeberger asked the council if they would appropriate the other half from Diversion.  Mr. Phelps made a motion for Mr. O’Connor to prepare a resolution to allocate $1,400 from Diversion for purchasing the copier, seconded by Mrs. Gustus.  All ayes.

 

Mr. John Tingley, representing Sentry Roofing, presented their bid for the city building roof.  After discussion among council members, the contract was sent to the Board of Works to be signed.

 

Mr. O’Connor said he would have information on how a Rainy Day Fund is created and bring it to the November council meeting.

 

NEW BUSINESS

Mrs. Gustus made a motion to set Tuesday, October 30 as the Trick or Treat date.  Children may Trick or Treat with the merchants from 5 to 6 p.m. and go door to door from 6 to 8 p.m.  Mr. Grant seconded the motion. All ayes.

 

Mr. Robert Smith, Director of Public Works, informed the council that the city could purchase clear, biodegradable leaf bags.  They cost $.14 per bag and can be deposed of easily.  Mayor Swift suggested Mrs. Mitchell purchase one thousand bags for a trial basis this year and the city will give them away for free.  These bags will be available from the clerk’s office during regular business hours.

 

City Attorney Tom O’Connor reminded the council that the State of Indiana prohibits open burning.  Our city ordinance states that if we can burn, then we can only burn on certain dates and times.  Mayor Swift told the council he would like to see the bagging of leaves, burning, and the use of the leaf vacuum this year within the city.  He would like to encourage the citizens to bag their leaves and/or let the city vacuum them.  Mrs. Gustus and Mrs. Maus stated they would like to see leaf bagging only for this year, no burning.  Mr. Phelps said he would like to see all three done this year and next year go to bagging only.  Mr. Grant agreed with Mr. Phelps.  Mayor Swift made the decision to bag, vacuum, and burn this year with 2001 being the final year to burn.  Mr. Phelps made a motion to set the burn dates from October 15 thru November 15, seconded by Mr. Grant.   Two ayes, two nays; Mayor Swift broke the tie by voting for the motion.

 

Mayor Swift informed the council the Board of Works has signed the license agreement with Phoenix Tank wherein antenna may be placed on the water tower.

 

Mayor Swift said he would like to arrange a tour of the Wastewater Treatment Plant for the council members, city employees, and citizens of Attica.  Since we spend approximately $500,000 a year on the facility, he thinks citizens might like to see where the money goes.  A date will be set at a Board of Works meeting.

 

ADJOURNMENT

There being no further business to be brought before the council, Mr. Phelps made a motion to adjourn, seconded by Mrs. Gustus.
